The Customer

The person whose name and other particulars appears below hereby applies to participate in a Empowerment & Kite Retreat by My Salty Sisters on the dates shown below (in this document that person is described as „the Customer“).

Risk Acknowledgement

The Customer acknowledges that there are inherent dangers both apparent and hidden associated with kiteboarding and associated with Empowerment & Kite Retreats. The Customer’s participation in the Empowerment & Kite Retreat and other associated activities may involve injury.

Loss, Damage Or Injury

To the full extent permitted at law, My Salty Sisters (personified by Anita Haslmayr and Janina Jonas, further just mentioned as “My Salty Sisters”) is excluded from any liability to the Customer and will not be responsible for any loss, damage or injury to the Customer arising from or connected with any activity conducted by My Salty Sisters no matter how that loss, damage or injury is caused. In particular, My Salty Sisters is not responsible for any loss or damage to a Customer arising from or relating to

  • the Customer’s failure or refusal to obey an instruction from an instructor of My Salty Sisters
  • any medical or psychological or mental condition of the Customer as the date of this contract. Furthermore, My Salty Sisters is not responsible for loss or damage to the Customer or any oft fhe property oft he Customer arising from any negligent act or omission of My Salty Sisters or any person for whom My Salty Sisters is responsible.

Physical Conditions

The Customer acknowledges and agrees that My Salty Sisters has no control in respect of weather, kiteboarding or other physical conditions during any Empowerment & Kite Retreat. My Salty Sisters is accordingly not liable for any loss, damage, inconvenience to any Customer or any property of any Customer arising from all or any of these factors.

Customer Property

Each Customer is solely responsible and liable for safekeeping of all the property of the Customer. My Salty Sisters has no responsibility for any loss through theft, breakage or otherwise of any property of any Customer.

Termination

My Salty Sisters reserves the sole and exclusive right to decide wether beach conditions, weather or other factors make any particular activity on an Empowerment & Kite Retreat unsafe or inadvisable and My Salty Sisters may terminate any activities of the Empowerment & Kite Retreat at any time for any reason without refund.

Refusal

My Salty Sisters reserves the sole and exclusive right at its absolute discretion to refuse any person including any Customer, for any reason to participate in any Empowerment & Kite Retreat or any part of any Empowerment & Kite Retreat wether that person has previously paid for an Empowerment & Kite Retreat or not.

Equipment

Where My Salty Sisters supplies equipment to any Customer, My Salty Sisters gives no warranty as to the condition or fitness of such equipment but will use its best endeavors to ensure that adequate equipment is made available. The Customer will pay for all damage to equipment provided by My Salty Sisters.

Directions & Instructions

The Customer must obey all directions and instructions from My Salty Sisters‘ staff and must not disturb other participants in any Empowerment & Kite Retreat or interfere with the Empowerment & Kite Retreat instructors‘ ability to conduct the Empowerment & Kite Retreat in a safe and secure manner.

Property

No Customer must damage, deface or remove and object from any beach or any of the equipment being used in any Empowerment & Kite Retreat.

Removal

My Salty Sisters reserves the absolute right at its discretion to remove from any Empowerment & Kite Retreat any Customer who does not comply with these terms without refund.

Basic Requirements

The basic requirements for all Customers are that they must be able to swim and must be 18 years of age and over, be of sound mind and in good health.

Medical Conditions

The Customer hereby declares that the Customer does not suffer from any medical condition which may prevent the Customer undertaking the Empowerment & Kite Retreat, including but not limited to acrophobia, epilepsy, dizziness, limb or back injury, angina or other heart condition, severe or uncontrolled asthma, visual impairment, depression or recovering from recent surgery.

At Own Risk

Each Customer participates in each Empowerment & Kite Retreat at his or her own risk.

Responsibilities

My Salty Sisters does not accept any responsibilities or any refunds in the following circumstances:

  • When the client is responsible for the incorrect delivery of the services.
  • When the defective services are due to third parties or they occur in an unpredictable manner.
  •  When the services can not be provided, due to conditions beyond the control of the company. These are unusal and unpredictable conditions which could result in unexpected consequences such as natural disasters or meteorological aspects etc.
  • When the incorrect delivery of the services is caused by happenings at My Salty Sisters, even tough all the diligences are taken, but they still could neither be predicted nor prevented.

Cancellations

My Salty Sisters reserves the right to cancel any trip in which case a full refund of the payed amount of the Empowerment & Kite Retreat will be made.

Non attendance or cancellations less than 30 days prior the trip commencement – no refund will be given. 

  • We will refund the Customer 50% of the total amount, if the cancellation is made at least 45 days before the beginning of the booked Empowerment & Kite Retreat.
  • We will refund the Customer 20% of the total amount, if the cancellation is made at least 30 days before the beginning of the booked Empowerment & Kite Retreat.
  • Within less than 30 days before the beginning of the booked Empowerment & Kite Retreat we do not refund. 

Currency

All prices / transactions are in Euros.

Payment

To validate the Customer’s inscription and to confirm the Customer’s booking at My Salty Sisters, 50% of the total amount must be paid within 14 days, after receiving the bill. The Customer can find all the bank details in the confirmation letter which we will send to the Customer by e-mail 1-3 days after the Customer fills in the booking form on the My Salty Sisters website. The booking will be considered as valid when the required amount of 50% has been transferred to My Salty Sisters bank account and the Customer has received a confirmation e-mail with the booking details.

Personal Information

All personal information including name, contact number & email address is used solely for the purpose of the booking at My Salty Sisters and will not be disclosed to anyone outside of My Salty Sisters.
